新興誹謗犯罪類型─校園網路誹謗案件分析

校園網路誹謗案件在近幾年成了新興的犯罪類型，許\多缺乏誹謗法律常識的學生與教職員，常因網路的匿名性忽略或漠視網路誹謗的嚴重後果。本研究聚焦探討此一重要課題，根據我國法律對於誹謗罪的相關規定，蒐集2008年6月之前的校園網路誹謗案例，依照網路媒介做分類，運用案例研究分析，從中了解法院對於校園網路誹謗的判決，以及相關現象的發展趨勢。
研究結果發現，不同網路媒介涉及討論的判決要件比重並不相同，法官在審理案件時，會將網路媒介特性與學術重要性列入考量，值得一提的是，「誹謗除罪化」在校園網路誹謗案例中已確實有此判決走向，本研究以為，誹謗除罪化的議題在應用時應更深入，以確保審判的周全性、合理性、公平性。

The cases of campus libel on Internet have becoming one of the new and developing criminal types recently. Because of the anonymousness on cyberspace, many students and instructors often ignore the serious consequences of defamation on Internet. The focus of this article on the important issue, based on the rulings of libel in Taiwan, the campus libel cases on Internet before June 2008 was collected and analyzed through the media characteristics of Internet.
The result shows that the different network media has different rates of judgment requirements in discussion. The judges have taken the specialty on Internet and the academic significance into consider. Especially to deserve to be mentioned, this research shows the decriminalization of defamation have existed in judgments of campus defamation on cyberspace. According to this research, the following suggestion can be drawn: The issue of the decriminalization of defamation should be more exact for rationality and fairness.
